Terms of Service

1. Agreement to Terms
These Terms of Service are an agreement between you and Obsidian Code LLC, a Virginia limited liability company doing business as "Whet" ("Whet," "we," "us"). By accessing or using whet.gg ("the Service"), you agree to be bound by these terms. If you do not agree, do not use the Service.
These Terms, together with our Privacy Policy and Responsible Gambling page, are the complete agreement between you and Whet; the latter two are incorporated into these Terms by reference.
2. Description of Service
Whet is a sports betting analytics platform. We provide odds comparison, expected value calculations, line movement tracking, and statistical projections. Whet does not accept, place, or facilitate wagers. We are an information and analytics tool only.
Whet is not a sportsbook, bookmaker, casino, or betting agent. We never handle your wagers, your winnings, or your bankroll, and nothing on Whet is betting, financial, or legal advice.
3. Eligibility
You must be at least 21 years old — or 18 where sports betting is legal at 18 in your jurisdiction — to use Whet. By using the Service, you represent and warrant that you meet this requirement.
Sports betting is not legal everywhere. You are responsible for knowing whether betting — and using betting-analytics tools — is legal where you live.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access. You may not share your account or use another person's account.
5. Subscription & Payment
Paid plans are billed on a recurring monthly or annual basis via Stripe. You authorize us to charge your payment method at each billing cycle. Cancellations take effect at the end of the current billing period.
Some plans start with a free trial — the length and the price after the trial are shown at checkout. If you don't cancel before the trial ends, your payment method is charged automatically for the first billing period. You can cancel anytime from the Billing page.
All charges are non-refundable, and no partial refunds are given for mid-cycle cancellations. As a courtesy, if you email support@whet.gg within 24 hours of a charge, we may — at our discretion — refund it in full.
If payment fails, Stripe will automatically retry. If all retries fail, your account will be downgraded to the free tier.
How Whet makes money: Whet is funded by paid subscriptions. We do not currently earn affiliate commissions, referral fees, or revenue sharing from any sportsbook — links to sportsbooks are provided only as a convenience to help you find the best available line. If this ever changes, we will disclose any such relationship clearly.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, scrape, or redistribute our data
- Share account access with unauthorized third parties
- Interfere with or disrupt the Service or its infrastructure
- Circumvent rate limits or access controls
7. Intellectual Property & Your License
All content, algorithms, data models, and visual designs on Whet are our intellectual property. You may not copy, modify, or distribute any part of the Service without written permission.
As long as you follow these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.
8. Your Content & Copyright
Parts of Whet let you share content — like picks and notes in the Community feed. You own what you post. By posting, you give us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content within the Service — that's what makes sharing work. Don't post anything unlawful, infringing, abusive, or misleading, including anything that promotes underage or illegal gambling. We may remove content or suspend accounts that break these rules.
Copyright complaints (DMCA): if you believe content on Whet infringes your copyright, email our designated agent at support@whet.gg with (1) the work you say is infringed, (2) the URL of the material, (3) your contact information, (4) a good-faith statement that the use isn't authorized, and (5) a statement, under penalty of perjury, that your notice is accurate and you're authorized to act. We respond to valid notices, including removing content and closing the accounts of repeat infringers.
Designated agent & counter-notice: send copyright notices to our designated agent — Copyright Agent, Obsidian Code LLC — at support@whet.gg. If your content was removed and you believe that was a mistake, you may send a counter-notice to the same address that includes your contact information, identifies the removed material and where it appeared, and states, under penalty of perjury, that you have a good-faith belief the material was removed by mistake. Unless the original complainant files a court action, we may restore the material in 10–14 business days.
9. Disclaimer of Warranties
Whet is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or timeliness of any data or projections. Past performance does not guarantee future results. All betting decisions are your own responsibility.
10. Limitation of Liability
To the maximum extent permitted by law, Whet and its operators shall not be liable for any indirect, incidental, special, or consequential damages — including lost profits, lost data, or gambling losses — arising from your use of the Service.
Our total liability for all claims, combined, is capped at the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) $100. Some places don't allow certain limits; where that's the case, our liability is limited to the smallest amount the law allows.
11. Indemnification
If your content, your use of the Service, or your violation of these terms causes a third party to bring a claim against us, you agree to cover the resulting costs and damages, including reasonable legal fees.
12. Termination
We may suspend or terminate your account immediately for fraud, illegal activity, abuse, non-payment, or where required by law. For other material violations of these terms, we will give you notice and a reasonable opportunity to cure (for example, 14 days) before terminating. Upon termination, your right to use the Service ceases. You may request account deletion at any time via Settings.
13. Changes to Terms
We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. Material changes will be communicated via email.
14. Dispute Resolution & Arbitration
Please read — this section affects your legal rights. You and Whet agree to resolve disputes through binding individual arbitration and to waive class actions and jury trials. You may opt out of arbitration within 30 days (see below).
Most issues can be solved with an email — before anything formal, contact us at support@whet.gg and we'll try to work it out within 60 days.
If we can't, you and Whet agree to resolve any dispute through binding individual arbitration instead of in court, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitration will happen in your county, by video, or by phone — your choice. AAA's rules cap your filing fees; we pay the rest as those rules require. The arbitrator can award the same individual relief a court could.
What this doesn't cover: either of us can still bring an individual claim in small-claims court, and either of us can ask a court to stop unauthorized use or abuse of the Service or our intellectual property.
Your right to opt out: you can reject this arbitration section, no penalty, by emailing support@whet.gg within 30 days of first accepting these terms, with your account email and a statement that you opt out of arbitration. Opting out doesn't affect any other part of these terms.
If 25 or more similar claims are filed by the same or coordinated counsel, the AAA's mass-arbitration procedures apply and claims may be batched.
15. Class Action Waiver
You and Whet agree that disputes can only be brought individually — not as a plaintiff or class member in any class, consolidated, or representative action, and not as a private attorney general. The arbitrator can't combine your claim with anyone else's or preside over any form of group proceeding. If a court finds this waiver unenforceable for a particular claim, that claim (and only that claim) goes to court — the rest stay in arbitration. To the extent a dispute does end up in court, you and we each waive the right to a jury trial.
16. Governing Law
These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law rules. Subject to the arbitration section above, any dispute not subject to arbitration must be brought in the state or federal courts located in Virginia, and you consent to their jurisdiction.
17. Miscellaneous
If part of these terms is found unenforceable, the rest still applies. These terms are the entire agreement between you and us about the Service. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets. We're not responsible for delays or failures caused by events outside our reasonable control. Sections that should naturally survive termination — like intellectual property, disclaimers, liability limits, and dispute resolution — survive.
